CONDITIONS OF USE

By advertising a garage sale online through www.whatgaragesale.com.au  you ("the Customer") agree to the following terms and conditions:

1. When advertising a garage sale, at the time of purchase the customer agrees to pay for advertising in accordance with our current rates and payment methods.
2. whatgaragesale.com.au PTY LTD does not offer refunds due to cancellation or postponement; however we will happily edit listing dates when provided with at least 48 hours notice.
3. You must ensure that your advertisement ("ad") and any material you provide us: (a) complies with these terms; (b) is not false or misleading or otherwise in  breach of the Trade Practices Act 1974 (Cth) or any equivalent legislation; (c) does not infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of privacy; (d) any items that you are not legally able to sell, including firearms, gaming machines, named travel tickets and American pit bulls; (e) does not contain any inappropriate, offensive, obscene, threatening, indecent, defamatory or confidential material; (f) is not discriminatory in breach of State or Commonwealth anti-discrimination legislation; and (g) does not use or disclose information (including any copy, photos or other pictorial representations) which identifies a person or which can be used to identify a person unless you have obtained that person's authority.
4. We provide whatgaragesale.com.au to bring buyers and sellers together, but are not involved in the actual transaction between sellers and buyers. We accept advertisements in good faith based on the obligations placed on each advertiser. As a result, we have no control over and, to the extent permitted by law, make no warranties in relation to, the suitability, quality, safety or legality of any items advertised for sale, the accuracy or completeness of any ads or the ability of sellers and buyers to complete a transaction. whatgaragesale.com.au PTY LTD cannot and does not guarantee that the site is free from errors or omissions and subsequently can accept no liability should an error or omission occur. 
5. We are not liable to you for any loss caused by you or by events outside our reasonable control. You are not liable to us for any loss caused by us or by events outside your reasonable control.
6. We may reject, withdraw or change your ad and any material you provide us if it breaches these Terms or a third party properly instructs us to do so. We will tell you if we do this.
7. Sellers must be prepared and willing to sell their items at the time of placing their ad. They must not advertise an item which is not intended to sell.
8. You agree that information contained on this Site is for personal use only and may not be sold, redistributed or used for any commercial purpose (this includes but is not limited to the use of Advertiser contact details for unsolicited commercial correspondence). You may download material from this Site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.
9. You may not modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this Site including code and software. You must not use this Site for any purpose that is unlawful or prohibited by these terms of use.
10. You may not use data mining, robots, screen scraping, or similar data gathering and extraction tools on this Site for establishing, maintaining, advancing or reproducing information contained on our Site on your own website or in any other publication, except with Our prior written consent.
11. While whatgaragesale.com.au PTY LTD takes all due care in ensuring the privacy and integrity of the information you provide, the possibility exists that this information could be unlawfully observed by a third party while in transit over the Internet or while stored on whatgaragesale.com.au PTY LTD systems or on the whatgaragesale.com.au PTY LTD site. whatgaragesale.com.au PTY LTD disclaims all liability to you to the greatest extent possible pursuant to law should this occur.

Third party sites are not part of the whatgaragesale.com.au PTY LTD site. These links are provided by us solely for your convenience.
    (b) We make no representations or warranties whatsoever about any third party site. We do not endorse, and accept no responsibility for, the content or use of any third party site. If you link to any third party site, you leave the whatgaragesale.com.au site and do so entirely at your own risk.

Competition terms and conditions

Advertise with us promotion

1. The promoter is www.whatgaragesale.com.au PTY LTD, P.O Box 1513, Runaway Bay, Queensland, 4216, ABN 41 138 179 923
2. There is one $50 prize available to win during each calendar month of 2009.
3. Entry into the monthly prize draw is automatic upon advertising your garage sale with www.whatgaragesale.com.au and paying the listing fee of $5. 
4. Only one entry per garage sale advertised is permitted.
5. The actual date of your garage sale determines which month’s draw you will be entered into, NOT the date you advertised with www.whatgaragesale.com.au
6. Entries period begins on the first calendar day of each month and ends on the last calendar day of each month.
7. One monthly winner will be drawn randomly from all entries received during each promotional period.
8. Employees and immediate family of the Promoters and their associated companies are ineligible to enter.
9. Prize draws will be conducted on the first day of each month.
10. Winners will be notified by telephone and/or email. Winners names will also be posted on www.whatgaragesale.com.au
11. The judge’s decision is final and no correspondence will be entered into.
12. The Promoters may in their absolute discretion suspend, cancel or recommence the promotion if:
    a. for any reason the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion; or
    b. the determination of the prize winners or the delivery of the prizes is prevented or hindered by any outside agent or event including but not limited to vandalism, power failure, tempest, natural disaster, acts of God, civil unrest or strikes or other industrial action.

    Post a review promotion
